Nine years of a decade Shanxi Province is suffering from drought. Water shortage has been the "bottleneck" of the economic and social development. At present, water conservancy infrastructure construction has made significant progress, which makes the focus and the difficulty of our work change from the development and utilization of water resources to the unified management of water resources. In other words, unified management and the optimal allocation of urban water resources is our ultimate goal. However, in our existing management system especially in the urban water supply management system, there are some long-standing phenomenon which makes it difficult to achieve, such as the urban-rural split, the separation of departments, the dual management of water management, conservation and protection.The paper makes the present situation and legal issues of urban water supply management system in Shanxi Province a starting point, and then sorts out and analyzes the present situation and problems of the legal system of China’s urban water supply system. It aims to learn from the successful experience of home and abroad in promoting the legal aspects of urban water supply management system, and analyze the crux why management system have been difficult to advance, then present the feasibility legal advices with a hope to provide reference on the promotion of structural reform about urban water supply in Shanxi and the whole China.Facing with the current problems in urban water supply management system, the paper states that from the legal system perspective the reason that the unified management and optimized allocation of urban water resources is difficult to achieve is the imperfection of legal system in the urban water supply management system, rather than unified management system and other major problems and deficiencies. The theoretical bases of the paper are some relevant laws and regulations, such as "The Constitution","The Water Law" and "The Property Law". It analyzes current domestic and foreign successful experience in promoting the legal aspects of the reform of the urban water supply management system, from the market economy and administrative point of view, as the principles of "sustainable development" and "who created pollution, who protect","who exploit, who protect" a legal basis, involving the law of value, supply and demand, competition in the market theory, and administrative efficiency theory. The paper presents four legal advices to advance the reform of the urban water supply system of Shanxi. First is to improve the legal system of the integrated management of water supply; The second is the specification of water rights ownership management; The third is the introduction of the legal system to promote the reform of the water supply system; The fourth is to promote the introduction of the water industry relevant legal system.
