Research On The Legal Risks Of The Power Supply Companies Under The Background Of The New Power System Reform

As energy supply enterprise of our country,the power supply company is the main channel of power resource allocation and the pioneer of national economy.It undertakes the power supply service task of power transmission and allocation,and plays a mainstay role in social and economic activities.Nowadays,with the rapid development of social economy,the system of electric power industry is undergoing a phased change,and the corresponding management system of the power supply company needs to be reformed accordingly.Because of the changes of internal and external environment,the power supply companies have more responsibilities and are facing more risks,especially legal risks.In March 2015,the Central Committee of the Communist Party of China and the State Council issued "Several Opinions on Further Deepening the Reform of Electric Power System" and decided to carry out a new round of electric power system reform.After that,the State Energy Administration issued six core supporting documents to reposition and promote the reform of China's electric power market.Under the environment of governing the country by law and enterprises by law,the power supply company should actively integrate legal risk management into the overall situation of the new round of power system reform and stability,take risk prevention as an important grasp to enhance the ability to operate according to law,establish a long-term mechanism for legal risk prevention,and reduce the adverse impact of legal risk on the company.Continuously improve the level of corporate governance according to law.On the basis of interpreting the reform documents,this paper mainly analyses the legal risks faced by the power supply company and puts forward specific preventive measures from three aspects:the compliance construction of self-owned power plants and grid-connected operation,the liberalization of incremental distribution investment and the reform of power sales side.First of all,according to the basic process of business,combined with the rule of law related,to study cases,legal disputes,business department summary report,data statistics analysis,review the record table,survey research and the legal subject description data as the foundation,gradually develop legal risk identification,outline of establishing risk control and synchronization.Secondly,it establishes the risk management and control evaluation system,builds the standard model of index analysis,organizes the personnel of relevant business departments to score the risk points according to the standard,and finally determines the results of various risk factors after thorough grade evaluation.Finally,on the basis of identification and assessment of various legal risks,we should integrate legal risk management with business management,carry out risk monitoring and control,put forward effective risk prevention measures,avoid or reduce the occurrence of legal risks,improve the effectiveness of legal risk control,enhance the ability of identification and early warning of legal risk points,and promote it.The legal risk prevention gateway moves forward and a three-dimensional legal risk prevention and control network has been built,which has achieved certain results.
