The Mediation System Based On State And Social As Radical Solution

The People’s Mediation System is a part of the legal system. It works outstandingly in solving legal disputes, and it ensured social stability.The establishment of People’s Mediation System and the installation of the automatic resolution model of social disputes (refer as the social model or the traditional model downwards) here in the country both have a historical attributes.As the country is in a process of transformation, there accompanied with many new types of disputes. So to speak, the traditional ways that were used to solve problems is somehow outdated. Under this circumstance, to build a more sophisticated and comprehensive social dispute-resolving mechanism is in an urgent need.This research paper started with a historical point of view concerning this matter. The similarities of People’s Mediation System and the automatic resolution model of social disputes were discussed, and the rationality of the practicality and development of People’s Mediation System was analyzed. Moreover, based on facts, some legal options about how to fluently operate the system were suggested.In addition to the introduction part, the paper was separated in three parts: firstly, the progress and development of the social model; secondly, the People’s Mediation System:the alterations and adjustments that had been made on the traditional model; and then, the optimization of the frameworks and the options of the strategies of the People’s Mediation System. The main contents were as followed:PartⅠ:the Progress and Development of the Social ModelIn this part of the study, the nation’s ancient and modern dispute-solving histories were reviewed. It is said that the traditional way has a significant meaning in an agricultural economy based country. By reviewing the history, the author promoted a social base of the People’s Mediation System.PartⅡ:the Alterations and Adjustments That Had Been Made on the Traditional ModelIn this part of the essay, the background information of social reforms was mentioned, and it is said that in this period, many new features are emerged in social disputes. Therefore, the old methods may not work as well as they used to do. It is only natural to follow the mainstream to adopt the new strategy referred as the People’s Mediation System.PartⅢ:the Optimization of the Frameworks and the Options of the Strategies of the People’s Mediation SystemThrough some field researches and observations, the author addressed that in the practices and operations of the new system, some problems appeared, such as imbalanced sentences and staffing problems. Accordingly, the author offered some means to improve the system in aspects of power distribution, human resources allocation and sentencing measurement.
