Europe has undoubtedly the most complete and mature legal system ofhuman rights protection in the world. The legal system of human rightsprotection under the framework of the Council of Europe has always beenplaying a good function. However, the European Union legal regimedevoted to promoting the economic development seems to have littleachievements in human rights protection. Although the latter do not havethe sound legislation and the superior traditional basis as the former, wecould not ignore its practice and theoretical exploration in recent years.Especially since the entry into force of the Lisbon Treaty, the EU legalsystem of human rights protection has been reflected considerable progressboth in judicial decisions and in the perfection of regulations.The article is intended to hackle the development vein of human rightsprotection legal system under the frame work of European Union throughits evolution and have its trend prospected.The first part of the paper will be divided into four stages, reviewingthe maturing and the development of human rights protection legal systemwithin the frame work of the European Community or the European Unionsince World War II. The second part discusses the current status of the EU human rightsprotection legal system from legal sources and organizational structure.The third part makes outlook of the future development trend of EUhuman rights protection legal system with the main content of the affectionof the Lisbon Treaty through the issue of legal effect of the "EU Charter ofFundamental Rights "and the issue of European Union joining "EuropeanConvention on Human Rights".
