The Research On Legal Supervision Of Foreign Capital’s Merging&Acquiring Commercial Banks

The launch and development of cross-multinational merging&acquiring banks is the product of a high degree of the bank industry’sgrowth. Meanwhile, because of new trend and characteristic’s launch,cross-multinational merging&acquiring banks adjusts and enrichescontinually. Since China joined in WTO, especially opening the businessof Renminbi, the phenomena of merging&acquiring China’s commercialbanks has became a central issue. CITI financial group merging&acquiring CGBC was a typical case.The thesis compares China’s legal institution of supervising foreigncapital’s merging&acquiring local commercial banks to the othernations’ by application of analyzing related supervision’s theory. On thebasis of theory and case studies, the thesis analyses the drawbacks ofChina’s contemporarily related legal institutions, and puts forward aproposal in order to perfect legal institutions. The proposal includes three parts. Firstly, China should confirm the law-governing thinking ofsupervising foreign capital merging&acquiring China’s commercialbanks. Secondly, China should meet the form of supervising foreigncapital merging&acquiring China’s commercial banks’ institutions to thestandard. Thirdly, China should perfect the contents of supervisingforeign capital merging&acquiring China’s commercial banks’institutions.
