This paper mainly studies the characteristics and the implementationsignificance of the copyright securitization, the legal issues which arisewhen securitization process is operating, and analyze American andJapan’s successful cases and the experience for our country, so as to getfurther discussion on the most suitable copyright market, at last makesome feasibility analysis on the implementation of the securitization ofcopyright, and give some suggestions on promoting the implementationof China’s copyright securitization.The copyright securitization has two aspects of the characteristic,one is the intellectual property right and the other is the financialsecurities, it is the innovation of the certain stage of the development ofknowledge economy. As an innovation of copyright’s development andoperation mode, the copyright securitization is very important both fordeveloping the system of copyright and expanding the financingchannels.There are some core legal problems in the actual operation of thecopyright securitization, such as the value evaluation of securitizationassets,"True sale","Risk isolation", solve these problems is the key tocomplete the copyright securitization.In combination with copyright securitization’s own particularity ofdevelopment, then through the feasibility analysis on the implementationof the copyright securitization in our country, there are two markets are suitable for our country to implement copyright securitization, one is thetraditional film market, the other is the emerging art auction market.At last, according to the present situation of the development ofChina copyright securitization market, some market regulatory proposaland legal proposal are in need, including improving financialintermediary market, regulating securities’ credit rating and creating goodcopyright production environment, and enacting specialized laws.
