Government reliance on society organizations to deliver government-funded service isa widespread, and growing practice in countries throughout the world. In most advancedindustrial countries such reliance is so widespread that society organizations havebecome the new way for public services.From the perspective of government’s function, public services shall be provided bythe government itself reasonably. However, there is no such rule in any country allaround the world that public services must be provided by the government. Andbecause of the monopoly of the government, the public services cant not get recognitionof citizens. With the rise of democratic society and parties, society organizations have astronger desire to enter into the field of public services. They constantly require thegovernment to open more spaces for private enterprises participating in public services.From the current situation in our country, society organizations have entered the publicservice, though it involved in the field is limited, it a wonderful beginning.This dissertation, after a theoretical overview of the government’s purchase of publicservices, focuses on the phenomenon of law deficiency during the process of purchase,and learns from the experiences abroad to perfect the legislation related to government’spurchase of public services to become the service-oriented government.In chapter One, the definition and feature of public services and government’spurchase of public services will be introduced briefly. The legal basis and administrativelaw basis, the necessity of government’s purchase of public services will be discoursed.Chapter2will mainly discuss the way foreign countries purchase public services andthe reference for our country. Each country has its own way and we should treat thoseways according to our nation’s own condition and not blindly follow them.Chapter3will introduce our country’s development in government’s purchase ofpublic services and the problem appear in the process.Chapter4is the main part of this dissertation—the legal regulation of government’spurchase of public services, it about the program and judicature. And then,the authorwill discuss it respectively from each subjects of providing the public services, namely,the government, the social organizations and the public. Accordingly, suggestions forthe three different subjects above during the specific operation of providing publicservices.
