Research On The Legal Regulation Of Government Purchasing Public Service

Government purchasing public services is a new mode of supply of public services,which can transform government functions,reduce service costs and improve service quality.In the 1990 s,through learning from the practice of purchasing public services by foreign governments and combining with local conditions,all parts of China began to explore the supply mode of purchasing public services by the government,thus breaking the traditional mode of providing public services directly by the government,and making the main body of public service supply diversified.However,due to the lack of theoretical research and the lack of theoretical knowledge,many problems have arisen in practice and legislation.A thorough study of the legal regulation of government purchasing public services is conducive to improving the theoretical system of public service diversification,deepening the government's practical work,providing theoretical support for the formulation of laws and regulations,and providing guidance for the development of practical activities throughout the country.At present,the main problems in the legal regulation of government purchasing public services in China are that the formulation of normative documents is not specific,the specific conditions and development of the subject of acceptance are not clear,the scope of government purchasing public services is vague,and the procedures of purchasing,such as acceptance procedures,public participation procedures and information disclosure procedures are not standardized enough.In addition,in government purchasing,the procedures of government purchasing are not standardized enough.On the supervision of purchasing public services,there are also some deficiencies in the subject of supervision,such as paying attention to internal supervision,ignoring external supervision and so on.The suggestions to improve the legal regulation of government purchasing public services include the following aspects.First of all,we should take the current "Government Procurement Law" as the main body,formulate separate laws and regulations related to government purchasing public services,and make special legal regulations to solve the problem that there are many normative documents,but the regulations are confused andunsystematic.Secondly,it is necessary to clarify the specific conditions of the undertaking subject and modify some normative documents that restrict its development.Then,aiming at the problem of the scope of public services purchased by the government,the purchasing contents should be categorized and specified.At the same time,we should standardize the acceptance procedures,strengthen public participation and expand information disclosure.Finally,we should strengthen the external supervision of government purchasing public services and establish a third-party professional supervision institution.
