Study On The System Of The Forest Ecological Benefit Compensation Fund

As is well-known，the forest has two main functions: one is the economic function;the other is ecological function. Realizing the economic function depends on logging，and the realization of the ecological function depends on growth. This is destined thatthe two functions can’t be realized at the same time. Each "rational people" are pursuingeconomic benefits， so they do not build ecological public welfare forest that playsecological function for the whole society ’s public interest. Only the country can bearthe responsibility， but this does not mean that there is only national direct investmentto build ecological public welfare forest，other organizations and individuals still canbuild forest.But they all build forest for economic interests， they will inevitably cutthem，at this moment， the country gains the ecological benefits of forest through theBanned logging or Limit logging. However the country can’t get free，otherwise， theorganization and individual do not build forests because of concerns about the forestwill be occupied free by the state， thus China’s forestry do not get better development.So， forest ecological benefit compensation system arises at the historic moment.Our country conducts compensation mainly through the establishment of forestecological benefit compensation fund. Although it has certain effect on the developmentof ecological public welfare forest， the result is not very ideal. This exposes that theforest ecological benefit compensation fund system has many problems. This paper willpoint out the problems and puts forward the corresponding solutions and perfectsuggestions. This paper first introduces the concept and connotation of forest ecologicalbenefits compensation， and defines the legal attribute of forest ecological benefitcompensation fund， thereby it establishes the foundation for below. Then the paperintroduces the legislation， general situation of Chinese forest ecological benefitcompensation fund system，and makes evaluation about it. Then the paper introducesthe legislation and some enlightenment to us of the foreign relevant forest ecologicalbenefit compensation，consequently， it provides reference for the research on ourcountry’s forest ecological benefit compensation fund system. Finally， in view of theshortcomings of China’s forest ecological benefit compensation fund system， the paperputs forward the perfect suggestions.
