Study On Compensation Mechanism For Forest Ecological Benefits In Hainan Province

Forest not only has an extremely important natural resources, these resources with high economic value, but also as a kind of unique ecosystems, forest has an extremely important ecological value.In order to improve the value of ecosystem services of forests, more and more countries take measures to protect domestic forest ecosystems,Hainan Province is no exception.For building of the ecological province and the national tourist island,Hainan Province take more measures to forest ecological construction and protection.But for protection of forest ecology we have to give up the pursuit of the economic value of forest resources,thus leading to conflicts between environmental protection and economic development projections.Then forest ecological compensation system came into being to alleviate this contradiction.At the moment,Because of the imperfect of forest ecological compensation system,chaotic of management system,the lack of compensation funds and other issues resulting in Hainan Province forest ecological compensation system can not be effectively implemented,forest Protection can not achieve the desired effect. Therefore,the Hainan provincial government should proceed with the improvement of legislation, and constantly improve the province's forest ecological compensation system to resolve the conflict between economic development and environmental protection of forest.This paper based on the current situation and problems of forest ecological compensation in Hainan Province and analysis and learn excellent experience from domestic and international,and then proposed legal countermeasures to to improve forest ecological compensation system in Hainan Province.Specifically,my research focuses on four aspects of this topic.Firstly, this section focuses on the legal connotation of forest ecological compensation, the legal basis of forest ecological compensation and the status of implementation of forest ecological compensation system in China.First,this section analyzes the domestic scholars definition of ecological compensation, then give my opinion on the definition of ecological compensation,and introduced the definition and content of forest ecological compensation.Then,this section analyzes the the legal basis of forest ecological compensation system.At last,This section describes the legislation and practice on forest ecological compensation system in China.Secondly, this section focuses on introduce practice and experience of implement forest ecological compensation system in other countries.For example,FONAFIFO in Costa Rica.So Hainan Province can refer to the excellent experience of these countries and constantly improved the forest ecological compensation system in the Hainan Province.Once again, this section analyzes the current situation of forest ecological compensation system in Hainan Province and its Problems.This section introduces the current laws and regulations of forest ecological compensation in Hainan Province, and detailed analysis of the important terms of laws and regulations of forest ecological compensation in Hainan Province.In addition,this section has introduced the status of forest ecological compensation practice in Hainan Province in detail.Although,some areas in Hainan Province have begun to actively explore innovative forest ecological compensation mode,but there also are many problems need to be solved. Such as forest ecological compensation legal system is not perfect, forest ecological benefit compensation mechanisms are inadequate and so on.Finally, this section introduces the legal countermeasures of perfecting forest ecological compensation system in Hainan Province.This section is divided into five small sections.Such as formulate Forest Ecological Compensation Ordinance of Hainan Province, establish a flexible way of forest ecological compensation and so on.
