Rural society has always been treated as a symbol of traditionalism and laggards inthe context of midernization. Rule by law of state develop a new social costruction, ofcourse, include country. About the problem, there been manypapers exist.Any a kind of social phenomenon is affected by path-dependent. To findhistory, the analysis of rual disputes, to look for the historical tradition of rural society,which include local justice. In general speaking, with modern improving, the traditionwill gradually disappear. But the research from anthropology shows that the traditionwill not disappear, on the contrary, it is probably prosperous. Based on this point,researching village justice, not only has a new visual angle for the dispute of resolve ofrural society, but also is a prospect of china rule by law.For the rural disputes solution and internal choice motivation analysis, we can lookinto rual governance structure, that how the order been constructured. Essential justice,fair and reasonable, case justice have always been treater as the traditional justice.Because the politic, economic, culture and society had changed at the new period, localjustice is also turn on the quiet. The basis of traditional society is the blood relationshipand marriage that will be replaced by business relationship. At the same time, it alsoshows that the country need state law, but the law must reflect the ture side of thecountry and express the villagers intrinsic demand.
