In the twentieth century, the Internet became one of the greatestinventions for the human. At the beginning, it was used for themilitary purposes, but started to play an irreplaceable role in variousfields for next years. It created a new era for the communications. TheInternet has natural tool properties, globalization, openness, sharingand freedom. These basic properties provide people convenience fortheir work and life, and strengthen the communication and exchangein the world wide. But on the other hand, the Internet is provided withfeasibility. Cyberspace makes influence on human society through itsnatural virtuality and reality.Because of its reality, the cyberspace is just the extension of the realworld. So people’s activities online should abide by the criterion ofconduct of the real world, or the Internet maybe develop into the safeharbor for crimes. Therefore, when someone’s activities violate legalrelationships, they should promptly be adjusted, and apply to theexisting laws and regulations. That is the legal theory basis of Internetreal-name system. However, how to notarize the behavior subjectsonline becomes more and more difficult, though it doesn’t puzzlepeople in the real world. As a result, Internet real-name system cameinto being to regulate Internet behaviors, and sanction cyberspacecrimes. Broadly speaking, China formulates laws and regulations tostandardize the Internet service providers and users’ activities onInternet real-name system. However, the absence of a comprehensivelegal system and the lower legal ranks, especially the personalinformation security issues involving Internet users, make thefeasibility of such system to be questioned.This paper expounds the legal dispute caused by the Internet real-name system from three aspects: support from legal, the right tofreedom of opinion and the personal information protection. Thepurpose is to show the real significances and the drawbacks resultingfrom practice, so as to improve the system to be valuable for thedevelopment of the Internet industry and social harmony and stability.In order to realize the Internet real-name system’s feasibility, I showthe recommendation in Chapter Ⅲ. They are technical support as astarting point to strengthen the protection of personal information;legislation for the protection, emphasizing step-by-step;people-oriented, and the creation of a harmonious networkenvironment. I hope these advices could contribute to theimplementation of the Internet real-name system. Of course, in viewof reality technology conditions being not ripe and inadequateguarantee for the consumers’ personal information security, the basicpremise of Internet real-name system is to ensure the safety of privateinformation. So the system should be prudently put into effect.
