The tobacco use in china is still keeping at a high level and personswho contact ETS are numerous although it is proved that smoking andpassive smoking are harmful for health. Smoking in public places willcause the non-smokers who live or work there got harm from the smokefog, and violate the health rights of the non-smokers. We should preventsmoking in public places. The countries who have good legislationexperiences on tobacco control indicate that establishing and executinglaws and regulations relating to no smoking in public places is aneffective way to mitigate the dangerous for passive smoking.―The Smoking Control Regulations in Public Places in Shanghai‖(short for―Regulations‖below) has been put into effect on March1st2010to reduce the passive smoking in public places. Tobacco controlmeasures such as posting no smoking signs, cancelling smoking settingsand discouraging smokers are successively used in each legal quit smoking places after the implementation of Regulations. Lawenforcement agencies also put the tobacco control law enforcement intothe daily inspection. The tobacco control effect in public places achievedinitial success. But the implementation of the Regulations is not sosatisfactory. The restaurant and entertainment places are still the hardesthits for tobacco control and enforcement penalties are also―speak louderthan word‖; dead spaces are also exist in tobacco controlmanagement……The effect of tobacco control may be difficult to sustainif we have no analysis of these problems and further resolutions. To thisend, this paper will analysis the present implement situation by using thetheory pattern of policy implementation and policy evaluation, then findthe way to promote the implementation of Regulations.This paper was divided into five parts. First, the paper describes thebackground, propose, method of the research and the present situations ofthe research at home and abroad. Second, it introduces the theoreticalframework about implementation effect and constraints for Regulationsusing model of policy implementation and Stakeholder model of policyevaluation as a theoretical foundation. Third, it describes the status ofRegulations implementation. It analyses the present implementationeffects and the existing problems by using large amounts of data. Fourth,it reveals the constraints of the Regulation implementation which comefrom the public, public places managers, law enforcement agencies and tobacco industries on the base of analysis of existing problems. Last, itproposes the solution for advancing the Regulation implementation. Wehope to create a tobacco control atmosphere to establish a long-termmechanism for tobacco control by improving tobacco control advocacy,strengthen supervision and law enforcement, advocating smoke-freepolicy, strengthen tobacco control capacity building.This paper has a large sample size which covered various types ofnon-smoking places plus the non-statutory non-smoking places ascontrols. Surveys carried out before and after the implementation of theRegulations(especially one month, six months, one year after that) toensure continuous data for the convincing results. It provides a referencefor the study of stop smoking in public places.At the same time, this paper can provide the data for department incharge and also provide the basis for consummating the regulations.
