In our country have a special legislation to control smoking in public places, so the problem is very outstanding.Shenyang, as the northeast as the center of the northeast’s largest city, facing the same problem, even more serious problems. Shenyang smoking rate is slightly higher than the national level, 3% of women smoke ratio is higher than the national average. To solve this problem only rely on moral constraints is not enough, this is a huge task, also is not going to get the job done. First from the legislation, Shenyang municipal government also issued relevant laws and regulations, before just regulations content is too simple, punishment is not strong enough, to perform the effect not beautiful, new regulations to control the situation, it is imperative to smoking in public places. This paper is according to Shenyang municipal people’s congress standing committee in 2013-2017 legislative planning one of 20 official project in the regulations on control of smoking in public places in Shenyang legislation needs to try.The author through to the legislation of control smoking in public places around the world to understand the city advanced legislative experience of several provinces and cities of our country, combing, an investigation of the current situation of the control of smoking in public places in Shenyang analysis and field visits, starting from the legislative background, legislative feasibility and necessity, Shenyang, analyzed the control of smoking in public places there are lack of specification, the status quo of legislation on smoking in public places and trend, then the proposal draft legislation on the basis of detailed analysis and legislative reason. As a proposal from the perspective of scholars put forward, the author can from Shenyang urban development and the actual needs of public health of body and mind, trying to mobilize the participation of the whole society, realize the government leadership, the whole situation.
