With the issue of Somali piracy becoming a focal point of international attention inrecent years, countries all over the world, including China, have devoted arduousefforts to suppressing Somali pirates. With the thorough development of anti-piracyactivities, it has for the first time been possible and feasible for China to formulatedomestic anti-piracy law.The thesis gives a brief introduction to the issue of Somali piracy, and discusses indetail certain institutions of international law pertaining to the suppression of piracyand activities that share common features with piracy, as well as the limitations ofthese institutions as reflected during the suppression of Somali piracy, so as to provethe necessity of domestic anti-piracy legislation. By having an in-depth discussionabout the legislative process and articles of Japan’s anti-piracy law, the authorconducts a brief analysis of Japan’s scheme other than piracy suppression, andprovides China’s domestic anti-piracy legislation with experience and lessons forreference. An analysis of the obverse and reverse aspects, including the constraintconditions, favorable factors and practical significance of China’s domesticanti-piracy legislation, is conducive to the formation of the following ideas: as a largecountry with increasingly frequent maritime activities and increasingly flourishingmaritime trade, China needs to view the issue of domestic anti-piracy legislation froma national strategic security perspective, and improve domestic maritime laws andpolicies including domestic anti-piracy law in accordance with the realities in China,in order to safeguard national economic security and world peace and development.This effort to integrate national strategy with legal development accords with China’snational interests and the requirements for the development of socialist legal system.
