Seen from the emergence and development of International Non-GovernmentalOrganizations (INGOs), they have been an important participant in relevant fields ofmodern international laws. Moreover, the concept of Civil Society has beenincreasingly popular and the social roles played by INGOs are continuously becomingmore indispensable than ever following the steps of globalization. At the same time,INGOs have been enhancing their impact to the international laws in the globalcommunity through their unremitting efforts in striving for legal and social positions.From the very early stage of being empowered with rights and obligations by certaininternational treaties, further to the stage of gaining Consultative Status from UN, andeven further to the stage of being eligible to participate in international judicialactivities and in the making of international rules, this progress has indicated theevolution of the legal status of INGOs in the arena of international laws and theirfuture orientation.Following the reform and opening up, INGOs were allowed to operate in China.Although the scope, width and depth of the operations of INGOs in China havebeen substantially increased during the past30or more years, most of them have notyet gained proper legal status under the Status Quo of the legislation framework inChina as a stationed country, in another word, they have not yet gained adequate legalsupport to their social operations. Such an absence has been against both the interestsof INGOs in carrying out their own activities and the interests of Chinese governmentin rendering proper administration and guidance.It is with such a consideration, the author intends to do a comparatively systematicstudy on how to better the legislation on the administration of INGOs in China andcome out with certain policy proposals through the efforts with this article insummarizing own coursework and working experience, in comparing the Status Quoand future orientation of INGOs’ legal status in the perspective of international law,and in analyzing the current development of INGOs in China and problems facedtherewith. With such efforts, the author also intends to give some contribution in triggering further research on relevant theories and more debates on future policies asan addition to her paper work serving only as personal learning summary and workingguidance.
