With the social transformation, as an important part ofthe superstructure, the judicial field shows the phenomenon that the cases the court concludedare increasing in the number and species, which truly reflects the trend of diverse andcomplex disputes in our society diverse. In the process of disputing resolution, the traditionaldispute resolution methods, such as mediation, conciliation, administrative processing and soon tend to decline. Laws, In particular, the administration of justice has been given the priorityposition in resolving the disputes. However, in the real trial, there are a lot of judicial "strangesituation", such as miscarriage of justice, judicial corruption and so on. This phenomenon isworrying. How to stop the positive entropy development of the eco-Justice, and achieve anegative entropy operation, is a critical and serious practical problem to the judiciary given bythe times.In the rule of law society, the administration of justice is considered to be the ultimatelyand most thorough way in resolving disputes and conflicts. Therefore, the administration ofjustice is seen as the last line of defense to maintain the social equity and justice, and theimportant indemnification to builde a socialist harmonious society. Once the administration ofjustice appears any problem, then the social stability and economic development will also beaffected. Judicial ecology environment is the assurance to achieve justice and maintain theadministration of justice. Therefore, building a negative entropy of eco-justice, and opening asmooth road to the social justice, has important theoretical and practical significance forprotecting the legitimate rights and interests of people, defending the authority of law, thesmooth progress of socialism country under-the-ruling-of-law in china and building a socialistharmonious society.Acrroding to analyzing the content and features of the Eco-Justice, this paper reveals ourjudicial status and problems, analyzes the reason of positive entropy eco-justice in many aspects, and proposes the countermeasures.The first part of this paper, acccoding to use the research methods of dialecticalmaterialism and historical materialism, analyzeing the theories about the eco-justice. Learningfrom the meaning of ecology in the natural environment, and refering to its concept features,the author give eco-justice a clear definition of the concept. Referencing to the relationalsystems theory, I discuss the elements and their functions, features and overall operatingmechanism of the eco-justice system.The second part, the author take China’s rural ecological justice for example, and dosome empirical analysis. Through the ecological status of rural judicial empiricalinvestigation, the author summe up two forms of China’s rural ecological justice, which arepositive and negative entropy. The author also analyze the causes which may lead to positiveentropy eco-justice, with a view to provide a theoretical guidance.The third part explores the basic principles that building negative entropy ecologicaljustice should be followed. Upholding the legal concept of Marxism, building the negativeentropy of the judicial ecology, and laying a solid foundation in construction the socialismcountry under-the-ruling-of-law, makes the concept of en-vironmentally friendly society moreperfect.The fourth portion discusses the correspondent countermeasures of building the negativeentropy of the judicial ecology. By analyzing the necessity and feasibility of the negativeentropy of the judicial ecology in china, in view of the reason which may due to the positiveentropy of judicial ecology, the author puts forward the countermeasures and suggestions,which may make our ecological construction perform its normal function, and realize theharmonious building of the judicial ecology. |
