Research On The Orientation Of Government Functions On The View Of Human Rights Dimension

The second session of the10thNational People’s Congress has given out a dignified announcement tothe world that ‘our government will respect and protect human rights’ will be carried into constitution,which means that our government has paid close attention to this issue and it has been switched intothe law system. Nowadays, the consciousness of citizens in safeguarding their legal rights has beenobviously strengthened with the formation of the awareness of modern citizens. However, due to thefeudal tradition as well as officialdom standard which has lasted for thousands of years. It is not rareto see the government sometimes ignores human rights. Therefore, it is essential for us to rethink andposition government functions on the view of human rights.This paper discusses and researches the location of government functions on four aspects of humanrights. First of all, it highlights that safeguarding the political rights of citizens to be soul ofgovernment functions, it especially highlights the leading role of civil political rights in against theprivilege and against the oppression and exploit; clarifies the relationship of citizen’s political rightsand government power, thereby provides the legal basis for positioning government functions.Secondly, it expounds the guarantee of civil economic rights is the foundation of governmentfunctions as well as the insurance of civil subsistence rights is the bottom line. Last but not least, itconfirms that the key of government functions is supposed to be protecting citizen’s cultural rights. Itmainly discussed the importance for our government to ensure the civil cultural rights in the light ofsafeguarding their rights of education and how governments motivate the development of cultural.This paper provides the basis and theoretical reference by rethinking and studying the position ofgovernment function on the view of human rights dimension of politics, economy, society, andculture.
