Analysis Of The Legal Regulations Of The Charity Organization Of PRC

As an important part of China’s social security system, the charity is one kind of redistributionof social resources establishing on the basis of social donations. The legislation of charity law mustrely on the interest of the public. The charity organization is the main supporter to hold charitableactivities having the non-governmental and nonprofit nature, with the characteristics of opennessand voluntariness. These organizations put the money and human resources together throughcollection and advocacy to help the poor and the old to relieve famine and disaster. The orderlyoperation of charity organization is the essential safeguard for the future development.The thesis will investigate and research legal regulations of the charity organization of PRCcomprehensively and deeply using the systemic and comparative analysis.This thesis consists ofthree parts.The first part introduces the theory about the charity and the charity organization. Based onthe definitions of “charity”,“relief”and “public welfare”,“non-government organization” and“charity organization”,this part proposes the differences in these concepts. Then discuss thenecessity of legal regulations of the charity organization on the basis of analyzing the developmentand characteristics of the charity organization.The second part analyzes the current status and defects of China charity legislation. Now thecharity organization often can not find the legal basis in practice because of the imperfection of thepresent charity legal system. In these cases, many problems come out. For example, the standard toset up a legal charity organization is high, the legislation rank is low and so on. So we suggest thatthe government should improve the charity legal system in respect of the access mechanism,supervision mechanism, donation mechanism and incentive mechanism.The third part elaborates a macro-concept in charity legal system’s building. Fatherly putforward some proposals in details in the field of charity regulation refer to the practice in China andother countries.
