Food safety is an important problem of the national economy and people’s livelihood. As the saying goes that "Hunger breeds discontent". The food security situation is not only reflected the quality of life of people of a country, but also reflect a country’s administrative system, economic development, people’s moral standards, and the country’s legal construction. In recent years, the food safety problems occurs frequently in China and A variety of food safety issues highlighted of repeated, all the food situation cause consumers to lose confidence. Due to the aspects Characteristics of asymmetric information, the wide implications and the irreversible loss, the food industry market failures become the norm. Therefore, the food safety supervision in shouldering the important task of the regulation of food markets and the regulation of food production. Although in2009China promulgated a special "Food Safety Law", but the legal system of China’s food security still lacks systematic and complete, enforcement system exists problems of the powers and responsibilities are not clear and the law enforcement is non-standard. In addition, the food safety legislation of rural and small workshops is vacancies.
