After the reform and opening up, after decades of development, China’s per capita gross national income has entered the ranks of middle-income countries, but at the same time, the level of regional economic differences, and the imbalance of industrial structure has become an increasingly prominent social stability is being challenged. In this case, the low-income areas may seek support to high-income areas in order to reduce inequality on public expenditure, and its form is from the level of government directly or indirectly, the financial transfer payment as a tax sharing replenishment system the financial transfer payment system plays a very important role.In recent years, the central government’s strong support, the higher finance continued to increase on the following (in particular, economic underdevelopment and economically underdeveloped areas, the western areas, poor areas, etc.), financial transfer payments, which greatly eased the grass-rootsfiscal spending issues. Yet to achieve the transfer payment to the original purpose and role of county and township government’s financial problems is still very difficult.Domestic scholars to study this system works a lot, but mostly just for the financial transfer payment of this economic system, hidden in the subsequent deep-seated phenomenon, that is less central-local relations.Meanwhile,China’s fisical transfer payment system is still relatively imperfect legislation.By studying other countries’fiscal transfer payments to the legal system and comparision to China’s financial transfer payment system,there are many defects.In the article,the author first discusses the financial transfer payment,including the financial transfer payment status of the legal system and operating conditions; Secondly,describes the United States and the Germany’s financial transfer to the legal system,the inspiration our country from democracy,the right to limitthe public interest in terms of China’s fiscal transfer payment to the legal system to perfect.Finally,in a constitutional perspective,China’s fiscal transfer payment system improment measures,including the identification of the financial transfer payments to the legislative goals,the establishment of the supproting legal system and the establishment of the entitylegal and procedural law.
