| This advance in theory will act on practice and then cause social changes.During the six years after proposing the socialist idea of rules of law, it hasindeed brought dramatic changes for the rules of law in China. From the repeatrevision of basic laws, such as contract law, criminal law, criminal procedurelaw, etc. to the presentation and implementation of the judge sentencingstandardization for criminal offences as well as from the legislative level to thejudicial level and the administrative level, the rules of law in China have madea great advance. This advance reflects the legislative improvement of legalsystems in various departments, suggests the judicial behaviours of the judicialauthorities at all levels and embodies the refinement of administrative functionsand the responsibility of administrative behaviours in the administrative units.However, to transform a theory into the guidelines of practice is a process. Thelegal and administrative work usually puts more emphasis on documents andregularization of basis. Therefore, if the socialist idea of rules of law wants toact on the specific judicial and administrative work, it is required to spendconsiderable time in transforming it into the mode of legislation, decrees andcodes of practice that should be respected while exercising public power. At thesame time, the model proposed by the socialist idea of rules of law is a thinkingmode. Just taking the judicial work for instance, every person engaged injudicial work has his own personal thoughts and ideas for the rules of law thatformed in the work process. How to unify these personal ideas into a socialistidea of rules of law still needs a long transformation process. When theindividual legal thoughts and the idea are unified, the changes in the entirejudicial work will undoubtedly spread from working culture to working models. The degree of such changes is also one of the issues that will be discussed inthis paper. It must be pointed out that the socialist idea of rules of law is notonly a legal thought, but also a governing philosophy. It has profound andlasting impacts which affect all the aspects of social management, so it isdifficult to list them and make in-depth analyses for them. The author writesabout the anti-corruption legal work which he engages in with the specificcharacteristics of anti-corruption work. From his own experiences andreflections, he demonstrates the changes caused by the socialist idea of rules oflaw and explores whether the socialist idea of rules of law has trulytransformed into formal legal forms as well as whether the working culture andmodels of judicial work truly make corresponding changes. |
