Analysis On Public Security Police’s Rights And Interests

As a developing country with a large population, China has changed fromsimply having adequate food and clothing society gradually to well-off society. In thistransition period, economic structure, distribution of interests, values have changeddeeply, all kinds of social contradictions, security problem appeared. Public securitydepartments and the police officers are the main force in maintaining social order, andthe confliction between criminals and police intensified. The public security policeofficers have contributed a lot in maintaining social order and protecting the rightsand interests of citizens. But at present, the basic-level police’s rights and interestsprotection has not been paid enough attention.The police’s rights and interests should be protected naturally. It is taken as aproblem to study, because the police’s rights and interests have been violatedfrequently, and protection for police is inadequate. In recent years, violent andnonviolent assaulting police phenomenons occurred again and again; individual rightsand interests of police are always lost. The traditional theory of human rightsrestraints police rights for human rights, emphasis on regulating administrativepowers, neglect the police themselves on rights and interests. Police rights almostbecome the corner which is forgotten, but the police rights protection is the inevitablerequirement of social legal system.We consider it debatable for the point which police are vulnerable, but it isundeniable that the basic level police pay and benefits do not match. The publicsecurity department is a huge team, it has many duties, multi levels. Basic police’senforcement and people’s interests are closely related. When a police has misconductor bad behavior, it will cause social backlash, corrupts the whole police’s image.Because the team was given too much honor and expect, sacrifice and dedicationphilosophy has been blended deeply into the police culture. The individual policeofficer is difficult to guard own rights. The author agrees with the strict police management, maintain the police overall image, to better serve the people, but thestrict police management must be based on the awareness that rights are the premiseof improving the strict police management.It is the duty of the police to protect others, but if their rights are not guaranteed,how to protect others? The police’s rights and interests is not only a legal concept, butalso a number of legal rights and internal rules which guarantee the police rights,including the legal and policy implementation. On one hand, the police are membersof ordinary citizens in the society, and they enjoy the same rights as other citizens,which is the universality of police rights and interests; on the other hand, as the policeconduct law enforcement to protect for the interests of the mass, they execute dutiesaccording to law, which is the special interests of the police. Police legal rights are aremarkable signs that the country moving toward the rule of law, democracy, andcivilization. Pay attention to the rights and interests, improve the law enforcementlevel, is to fully protect the legitimate rights and interests of the masses, is strategywhich builds a socialist country ruled by law.The rights and interests of foreign police gave us some inspiration; they also setvery good examples in the perfection of law, administration, and human rightsorganization. This paper is from the basic police perspective, combined with their lawenforcement of police rights and interests protection. We try to analyze the basic levelpolice rights and interests from the police force, non-police activities, lawenforcement, administrative measures, the lack of law and operability etc.We would like to search for the deeper reasons, seek the way that solves theproblem, and explore the mechanism including administrative, legal, organizationalconstruction which could guarantee the rights and interests of the police. Based on theanalysis of the rights and interests for the grassroots public security police, we findthe difference, also find its way. The first is the concept to improve, the traditionalmilitary culture promote the sacrifice and dedication idea, avoided the rights andinterests of the subject; secondly, the system construction should be built step by step,continuous improvement for legal and administrative system to promote police rightssystem construction; public support is essential to promote the police lawenforcement, in the interests of consistency, but not the relationship between opposites, can deepen police and the people’s communication and understanding.National stability is inseparable from the basic level public security. The strongand solid base is urgently needed during this social transition period. A large numberof law enforcement generalists are needed, and more highly qualified legal officersare necessary for police law enforcement. The clever heroes are expected for our teamconstruction, especially for basic level. As we know, different culture attractsdifferent talents. We expect the police to protect the interests of people; we hope allthe benefits could be fully satisfied. Only the improvement of the legal system is theroot for the rapid economic development, people’s life and our country’s thriving andprosperous.
