Cultural relics in our country are not only material wealth, bus also a precious spirit wealth deigned by five thousand years’Chinese civilization. It records compatriots’memories and shows the world our country’s long history. However, since the reform and opening up, going with the continuous acceleration of urbane progress in our country, more and more cultural relics have disappeared in the modernization build. Especially the rising waves of real estate development in latest years, ancient constructions and relics have been destroyed more and more seriously. In the view of legal, this paper mainly discusses how to make government departments of relics’ protection carry out their obligations in order to keep ancient constructions and relics safe. Meanwhile, the paper uses advanced experiences of protecting relics in western developed nations for reference, and offers proposals to optimize functions of departments of protecting relics in our country and enact some laws and regulations.There are four parts in this paper. Firstly, the writer introduces a case and government actions of dealing with similar cases formerly. Secondly, it mainly discusses some law problems involved the case. Thirdly, it mainly describes advanced experiences of protecting relics in developed countries and problems existed in actual works of protecting relics in our country. Finally, the writer gives improved advices for our country in the law issues of protecting cultural relics and sites, Including to strengthen the legislative work, giving the front right of approval of the heritage sector in the course of real estate development, real estate companies blacklist system, heritage conservation contingency plans for system, and the establishment of the heritage police system..
