The employer collided with employee very frequently in China, the whole society turned the attention on it, the major contradiction between employer and employee is more and more clear, the fact is we need to figure out a good way to deal with this kind of relationship, try to make it become a win situation. The core of the contradiction between the employer and the employee is the payment for work. Employee should have the right to get their own payment after work, between the two parties it is the key point and the basic right for employee. The 《Constitution of PRC》、《Labor Law of the PRC》、《Labor Contract Law of the PRC》 all show us that the people who work and they have right to get the payment and we have a lot of way to protect this right. However, many phenomenon telling us that, the right to get payment is to be hurtled quite badly, it includes low payment, the increase rate is low, reduction of wages and the delay of payment and so on. Protection for the right of payment is relate to most workers’ profit, it is considered to be the balance the safety of our society, perfect the theory and figure out some laws about it is a very important job.As the solution to the conflict, collective bargaining is a way that western countries use to solve problem, our collective bargaining system has been set up and has made great progress, because the current system restriction, our collective bargaining system need to improved. On our way to set up the collective bargaining system, not only to need regulate itself but also need to move the collective bargaining system form companies to industry and regional negotiation, let the innovation to change our rules. Industry level collective bargaining system in western countries is quite strict and success, when we try to due with some conflicts, we can learn from them, let the Industry level collective bargaining system become valuable. We believe that on the way to learn the collective bargaining system, use the system to reduce the conflicts between the employer and employee, fine the way to cooperate, it can help us to changing our situation to become win situation.
