In the protection of the public interests premise,protectionprivate rights has an important practical significance. Also it is the important content of"rule of law".We must overcome all sorts of factors in preventing the realization of theprivate right,improve the path of the rights realization,perfect the system design,and protectthe private rights in the substantive law and the procedural law.In March2004, the state council issued by the comprehensive advancement legaladministration outline,in article9,it raised:"To give full play to the administrative planning,administrative guidance and administrative contract and other way role." It is the strategictask of our administrative management and administrative legal system reform.At thepresent stage, with china’s economic and social development,the use of regionaladministrative planning is particularly common.
