The Jury System And Its Reform

The jury system in China in ancient times they have similar cultural traditions,whichwas introduced into China in the late Qing Dynasty, tried in the Republic of China in thecounter-revolutionary cases, developed in the base period,through ups and downs after thecountry founding and eventually established now. China’s current Constitution does notmake any provision for the jury system, the relevant provisions of the jury system in thePeople’s Republic of China People’s Court Organization Law, Criminal Procedure Law ofthe People’s Republic of China, People’s Republic of China Civil Procedure Law","administrative Litigation Law of the people’s Republic of China,"National People’sCongress Standing Committee on the decision to improve the people’s jury system,"Supreme People’s Court, the Justice Department on the work of people’s jurors theselection, training, assessment implementation of views "and the Supreme Court on thepeople’s jury management approach (Trial)"matching requirements. Although theconstruction of the jury system has got some successes, but there are still many problemsin the judicial practice. For example, the jury system failed to give full play to its functions,the system itself has also undergone some alienation and so on. Problems arising inpractice caused a controversy of the jurisprudence of the jury system, some scholars haveadvocated strengthening the people’s jury system, some have advocated the abolition ofthe jury system, the debate focused mainly on the democratization of judicial, judicialjustice and cultural traditions aspects. At the same time, a lot of local people’s jury systemreforms, such as the jury of the pilot reform; in some places to take measures to strengthenpeople’s jurors. The success of these reform measures is also inadequate, so we need tofurther promote the reform of the jury system, do some conditional transplantation in ourcountry, to make sure the jury system really play a role.
