In 2012,it has been over twenty years since world’s first short message was sent. Undeniably short message has an imperative role to play in delivering convenience and efficiency in daily communication and interaction. However last decades has witnessed a substantial growth of spam messages, which is accompanied with the disturbing phenomenon of disclosure of personal information,occurrence of advertising frauds and even violation of property rights and human rights. Without question these negative happenings have overwhelmingly disturbed routine life of city dwellers.This article has a highlight on analyzing the spam message issue and attempts to search out alternatives to curb the phenomenon. Equally important is the article throws some light on interpreting concepts relating to spam message, subject and object of the infringement of tort, spam message’s principles of tort liability and the liability of forms. With reference to rational and effective measures implemented in other countries, this article endeavors to seek alternatives tackling with the disturbing phenomenon.There are mainly three sections in the article that constitute introduction, body parts and conclusions. It is noted that in body sections are consisted of four main subsections.In specific, section one provides an overview of the spam messages. In this section, the concept of the spam message is well discussed and interpreted.Noteworthy is that a variety of conceptual aspects are related to the spam messages.Equally salient is the section defines objectives along with scale and scope of the research, which is imperative to guide the further research. Indicated by concepts raised in this session, characteristics and categories of spam messages can be well identified and proposed.Further, section two has an emphasis on discussing underlying causes and latent risks in relation to spam messages. Conceivably despite short message is merely the text, it does have a close link with life quality. This is mainly due to the fact that hazards of spam messages are fairly substantial and thus should be given sufficient attention to look into. Moreover importantly it is to bear in mind that analysis of latent causes of spam message will have a substantial attribute to enhance effectiveness and efficiency eliminating spam messages in the society. The third section, also the main part of the article, has a highlight discussing spam message related infringement. This section analyses subject and object of the infringement actions. This section also proposes my own opinions relating to current legal gaps existing in law system and explains the necessity and possibility of implementing imputation principles in contemporary China.Last but not least, section four proposes current regulations in relation to spam messages in China. Specifically the consultation is performed by firstly grouping efficient alternatives adapted in other nations in to various categories. It is believed that the purpose of this is to enable Chinese regulation makers to possess a better understanding of pros and cons of alternatives and propose our own. This section also has an attempt to provide suggestions to management of spam messages from perspectives of enhanced telecommunication supervision, adoption of real name scheme and other spam messages related aspects.
