As the Internet develops and popularizes, the number of participants in on-line game is increasing, and the on-line games have generated a huge market. Among the frequent conflicts related to the virtual properties in the on-line games, the most controversial category is the theft of virtual properties. Due to the lack of the clear definition of the virtual properties and the theft of that, the relevant crimes were frequently committed without suitable conviction. It’s imperative to protect the virtual properties. Thus the investigation of the nature of virtual properties theft bears both theoretical significance and practical value. Regarding the topic, hereby we propose ideas as the following five parts:1. An introduction of the case is offered;2. The focus of the controversy was summarized by the inquisition of the case. Due to the lack of definition of virtual properties and theft of that, lots of controversies were aroused during the process of inquisition, including whether virtual properties belong to the properties addressed by law, recognize the nature of theft of the virtual properties, how to evaluate the value of virtual properties and whether electronic data can be used as evidence;3. The focus of controversies was analyzed based on theories of law;4. The conclusion was given. The meaning, characteristics and property in law of virtual properties were discussed. Virtual properties were justified as properties in the sense of criminal law and can be treated as objective of theft. Standards and methods of identifying the value of virtual properties were proposed. Electronic data were justified as evidence for prosecution and can be used independently;5. A suggestion of improving the lawful protection of virtual properties in our country was proposed. A brief introduction of current protect of virtual properties in foreign countries as well as Hong Kong and Taiwan. Some typical cases in mainland China were also reviewed. According to the present legislation and judicial status of our country, it is can be done to protect network virtual property through judicial interpretation, the Criminal Law Amendment Act, and a single line of criminal law.
