Safeguarding legal rights is the spontaneous mission of the Labor Union, also social basis of existence for the organization. In recent years, the Labor Unions at various levels throughout the country had done a lot of work and made great achievements in aspects of safeguarding workers’ legal rights and promoting the development of enterprises. But due to the inertial thinking of the operating mode in period of Planned economy and restriction of complex factors such as management system and operation mechanism, the work of safeguarding legal rights by the Labor Union encounter lots of difficulties, the dialectical relationship between safeguarding rights by the Labor Union and enterprise development is also hard to be interpreted correctly. This situation twisted the essential attribute of the Labor Union, impacted its state and prestige among worker masses, produced negative effects in carrying out scientific development view and constructing harmonious work relations.This essay based on the practice of safeguarding legal rights in provincial large-scale state-owned enterprise--LANZHOU LANSHI Group Company Limited, on basis of populace histology, histology, organizational behavior, sociology, the Labor law, political sociology and so on, through the methods of documental analysis, historical analysis, comparative analysis, questionnaire survey and case interview. The essay briefly summarized achievements in safeguarding legal rights by the Labor Union in LANZHOU LANSHI Group Company Limited, elaborated the dialectical relationship between safeguarding rights by the Labor Union and enterprise development, from aspects of economic dependence, status of lacking attention, construction of Labor Union team, difficulties in safeguarding workers’ legal rights, lacking of operability in collective wage consultation and so on. The essay also probed into the reason and difficulties of safeguarding worker’ rights, gave some corresponding suggestions in aspects of party and workers’ benign interaction, strengthening the team construction, rebuilding the workers’ trust on labor union, implementing the leadership of the union election system, establishing and improving staff demand expression mechanism, improving recognition of the Labor Union between workers and enterprise, grasping the key work of safeguarding worker’ rights and etc, provided some useful reference for other enterprises’ Labor Union and expected to recover fully function of the Labor Union in safeguarding worker’s legal rights and promoting development of enterprises.
