On The Npc Stangding Committee Political Function

The NPC Standing Committee as the permanent body of the National People’s Congress，has Thevarious Powers and Functions prescribed in the Constitution and other state laws. Being an independentpolitical status， an integral part of Power Operation， and an important component of Chinese politicalsystem， it occupies a central place， playing quite an important role，in efforts to build constitutionalism.For a variety of reasons, Standing Committee has failed to reach its Administrative Power Within thePurview of Constitution. Called the well-known rubber stamp as ineffective and unsophisticated asNational People’s Congress，it failed the supreme organ of state authority. For the above，to study theStanding Committee is of significant importance.The repot on work of the NPC Standing Committee, as a report from The NPC standing Committeeregarding the situation of each year in session of the National People’s Congress, contains profuseinformation. This paper applys the empirical researth methods to analyze the political funcitions of theNPC Stangding Committee in according with the provisioms of The constitution and the above-mentionedreport. In this paper I believe that the political function of the NPC Standing Committee contains twoaspects, one is the exrernal function-to serve the overall situation of the party and the State; for the other isinternal function-to perfect the system of People’s Congress and to demonstate the internal function on thebasis of the information contained in above-mentioned report. In addition, this paper further analyzes thereason of the two function.The external function of the NPC Standing Committee cause of the People’sCongress system created under the leadership of the party, the party’s ruling status and settings of theStanding Committee of the National People’s Congress party;the reason of internal function of the NPCStanding Committee is inextricably linked with the authority’s position of the NPC Standing Committeeand role of the elected representatives organ.Finally, by studying the relations between the two kinds ofpolitical functions, I think that the realization of the function of the external and internal functions in theNational People’s Congress standing committee is inseparable, and also the realization of the function ofthe internal will rely on the external function, but also a departure exists between the two functions, andthe realization of the external sexual function is better than internal sexual function, the typical presentation is the NPC Standing Committee on part of the powers of selective neglect. And attempted to find out theproposed solution about functional divergence in the National People’s Congress standing committee,namely "house of party and people’s congress", the party of national affairs of opinions and decisions in theparty congress is not formed on the resolution, and then give it to the people’s congress and its standingcommittee to do legal endorsement. But sent directly into the people’s congresses to discuss by the NPCparty members and then have the people’s congress and its standing committee to make decisions. Thecommunist party of China mainly realizes its leadership through the NPC and its standing committee of theparty member representatives, so as to realize the behavior of the communist party of China into the NPCand the standing committee to avoid conflict.In this paper, the study on the political function of the NPC Standing Committee helps us understandthe role and status of the NPC Standing Committee in the Chinese political power system and the problemsin current operation.And trying to solve the problems in the practical operation, and so as to improve thesystem of people’s congresses, construct China’s constitutionalism system reasonably and politicalcivilization of socialism with Chinese characteristics.
