Study On Constitutional Protection Of Personal Dignity In China

Personal dignity refers to the people’s independent identity, equal status and actionautonomy as legal subjects, it also includes the right of free decision and to enjoy all therights that legal subjects are endowed by law. Personal dignity is the base for other basicrights in constitution, the maximum value and ultimate principle for constitutional order aswell as the base for the country’s existence legitimacy. As the core right of constitution,personal dignity is not allowed to be deprived and restricted, which requires the country tobase all its decisions on the principle of protecting and respecting personal dignity. Besidethe obligation not to invade and interfere it in passive way, Country also shoulder theobligation to remove the obstruction on personal dignity and try best to create pleasantenvironment for maintaining it. However, the present constitution have not fully realizedthe value and status possessed by personal dignity and did not pay enough attention toprotecting and relieving it, which causes the frequent occurrence of invading personaldignity.
