Pre-school education as an important part of basic education is a critical period ofdevelopment of the individual. From a personal point of view, the basic role in thepromotion of the comprehensive health development of the individual; from theperspective of national education, it has laid the foundation of consolidaring andenhancing the quality and efficiency of compulsory education; and it has an importantguiding role to enhance the national overall quality. The fundamental nature of thepre-school education is a public good. Putting Pre-school education into the publicservice system, the healthy orderly development of pre-school education are also theimportant responsibilities of modern government. To crack the many outstandingproblems of pre-school development, through legislation to protect the healthydevelopment of China’s pre-school education, which is now the urgent needs of China’spre-school development process.Review the course of development of our pre-school and analysis of the pre-schoolstatus quo, the current development of China’s pre-school career there are still manyoutstanding issues: serious shortage of the pre-school administrative power, loss ofeffective protection; pre-school development of the lack of basic funding for securityGovernment stipulates that the State financial investment or investing little in thepre-school education; kindergarten office park and put into the system has undergone afundamental change to the urgent need to build pre-school education in the process ofbuilding a social public service system of the new system; preschool teacher preparation,lack of benefits protection, leading the team instability; the private power of varioussocial conditions of the office park, the powers and responsibilities of the lack of normsand security. Addressing the root causes these problems, there must be legal norms andthe protection of the upper.Therefore, the lack of pre-school specialized law hasseriously restricted the healthy and orderly development of China’s pre-school career.This paper attempts to analysis of the necessity of pre-school legislation in Chinaby discuss laws and characteristics of pre-school education, the current developmentand problems of China’s pre-school education and produced, the exploration of of thelegitimacy of the pre-school education in China and the legal and practical basis.And pointed out that the legislative process of pre-school education in China should alwaysput the equity in education and lifelong education as the guidance of concept put theConstitution and of the education law as total lead of the pre-school education law, anddrawing on international pre-school education-related laws and our pre-schoolregulations, local Ordinance and its implementation experience to provide advice andrecommendations in according with China’s national conditions to ensure that China’spre-school healthy and orderly development under the legal protection.
