Analysis And Proposals On Current Situation Of The Higher Education Management By Law

The Party's 15th congress put forward that China would run state affairs according to law. The idea of ruling by law should be displayed as lawful management in higher education field. Running school according to law is an essential part of legislative administration strategy, which is the basic requirement for establishing modern university system and high level university.Since the establishment of PRC, especially the implementation of reform and open policy, with the wide and profound spreading of the conception of management by law and the promotion of education legislation, significant progresses in higher education management by law has been achieved in China, and the effectiveness is evident. At the same time, with the further development of market economy, reforms and the higher education reform has been deepened, the lack of the higher education has also gradually revealed the need to be strengthened and improved. There are several opinions from Ministry of education in 2003 on the strengthening the higher education management by law: generally speaking, there is a certain distance between governing higher education by law and governing a country by law. The research on higher education management by law can enrich the legal theory of our country's higher education, and have a reference to the numerous colleges workers in education, teaching and management process, and promote the process of higher education management by law.Based on the dialectical materialism and historical materialism of world view and methodology as guidance, adhere to the combining theory with practice, using the principle of administrative jurisprudence, law and pedagogy theory knowledge, concrete by historical documents method, comparative analysis and comprehensive induction research methods of colleges and universities according to the law of the relevant theoretical and practical issues discussed and research, this paper expounds the basic theories of lawful management basis, through colleges and universities in China are analyzed, and the higher education management by law in China by corresponding main points out the problems in the work of colleges and universities in China to strengthen legal management work, put forward beneficial recommendations for university management personnel and higher education workers in accordance with the law, strengthen management, improve the level of lawful management to provide theoretical reference.This article is divided into five parts. The first part is preface, introduces the research background of the higher education management by law, significance, domestic and foreign research status and its research idea and research method. The second part summarized expounds the basic knowledge of the higher education management by law. First of all, introduced the higher education management by law is how to put forward; Secondly, subject, object and content from three aspects of the higher education management by law concept definition, Again, identified by corresponding working target, Finally, the value of the higher education management by law analysis, elaborated the practical significance of the higher education management by law. The third part analyzes the present situation of the higher education management by law in China, with the gradual improvement education legal system construction, the works of the higher education management by law gets many achievements, university management level enhances unceasingly. But overall, there are inevitablymany problems exist, mainly including: rules and regulations within the school is not perfect, some regulations and existing laws conflict, explicit power system has not been formed, proper procedure was badly neglected; law enforcement supervision mechanism is imperfect, etc. This section also analysed the causes of the problems. The fourth part is the focus of this article, on the basis of the previous text, offer some proposal for the higher education management by law: to establish internal regulations legitimacy review mechanism, perfect system of operation procedure, the perfection of college education law enforcement supervision operation safeguard mechanism, strengthen the rule of the higher education management by law, set up the conception of rule of publicity. The fifth part is the conclusion, this section gives a brief summary of the full text.Overall, although this article summed up some essential problems in the higher education management by law, on the analysis of the status of the higher education management by law, based on strengthening the higher education management by law by corresponding suggestions are put forward, however, due to the limited level, this article didn't analyse in depth and detailed on the problems which exist in the higher education management by law, the advise also lacked more in-depth research and thinking. In the future,for the higher education management by law, that is needed us to discuss and mine further to better the topic and improve the level of our higher education management by law.
