The Formation And Development Of The Legal Science And Technology View In The People’s Republic Of China

The experience and reality of socialist construction tells us that the development of modern science and technology, should not only rely on the wise decision in line with national conditions, the deliberate plan, the proper deployment and implementation, but also should it rely on the good social and legal environment. The decision-making, planning, deployment and management of technology would be difficult to have the authority, continuity, persistence, and effectiveness, if without the will of the people to confirm the form of law, security and support.Since in the mid-1980s, China has combined Law and Science and Technology, With the development of scientific and technological constitution reform, China’s Legal System construction is developing rapidly.The first chapter of this thesis is the theoretical basis, it tells the change of modern science and technology elements and the interaction between law and Science and Technology. The change of modern science and technology is becoming more complex, so it needs the law to adjust the internal relations and external environment of the Scientific and Technological activities, the combination of Science and Technology and the law is an inevitable trend.Chapter Ⅱ of this paper focuses on the establishment of the scientific and technological legal concept of new China. The first part discusses problems of science and technology activities, under the influence of politics of science and technology concept, and the legal deficiencies. The second part discusses the change of political direction and policy, and the establishment of the legal science and technology view.The third chapter is about the establishment and development of the legal science and technology view. The first part tell the establishment of the legal science and technology view has become the mainstream direction of the viewpoint of science and technology. The second part tell us that The legal science and technology view in china has been added with the international factors, which prompted the legal system of China’s science and technology international.
