The Allocation System Of Land Problems In Application And Perfect

The survival and development of a country is basically guaranteed by its land, the system of which reveals the national constitution directly. Under the planned economy, the land is used according to allocation. Since the Reform and Opening-up, during the transformation from planned to market economy, and the adoption of the compensation use of land, a double track system, namely, the coexistence of the new transfer and the old allocation system came into being. However, due to vague definition and application, the allocation exposes more and more defects, which injure the normal land market, leaving it in chaos and the social public welfare at a loss. As a result, the application is found fault with theoretically and practically, while somebody even propose the cancel of it.In recent years, as the society developing, the land transfers more and more rapidly, causing more and more conflicts between the two modes. Especially, the allocation gets a lot of problems in definition and application, even leads to unfair competition. All the problems are extensively concerned, and some scholars proceed to make some improve or reconstruct. The humble author want to give some points on the topic.The thesis consists of three parts, firstly, the definition of the allocation mode, its characters, scope and principle of application, secondly, the defects and harms of the allocation, lastly, some suggestion ways to its reform and perfection.
