The most dangerous stage of the global financial crisis began in the U.S. WallStreet is over. When the world’s major economies gradually go out of the financialcrisis, economic recession and financial control "chaotic" state, governments areturning their attention to the crisis exposed a large number of control vulnerability andhave started financial reform plans. They want to consolidate and improve thecountry’s financial system, to reshape the basic value of financial regulation and torestore market confidence by the way of updating or innovating financial mechanismsand strengthening protection of financial consumers. China should be based on theconstruction of Shanghai international financial center, put financial consumer rightsprotection as an important direction of the reforms of the financial regulationmechanisms, to establish legislative principles of financial regulation for the tiltprotection, system protection and appropriate protection for consumers and thefinancial consumer’s protection-oriented system of financial regulation.This paper is divided into three main sections, a total of six chapters, about50,000words.A mature and effective financial regulation system should include at least threeparts: First, financial regulation belief, that is, the financial regulation value orientation; Second, comprehensive financial regulation legislation; Third, effectivefinancial regulatory framework to deal with risks. Row context of this paper isabbreviated in accordance with the above ideas. The first part, the author proposes therecommendations that the financial consumer protection, as the basic value offinancial regulation should return, after thinking of the plight of financial control dueto the lack of financial consumer protection philosophy, and then demonstrates theimportance and the need of the financial consumer protection from the point of viewof academic theory and historical practice; The second part, the author illustrates thebasic legislation principle of financial regulation under the guidance of financialconsumers philosophy and states the status quo of financial regulation legislation ofmain developed countries for the protection of financial consumers; The third part, theauthor mainly solves the reconstruction of specific financial regulation mechanismsunder the philosophy of the financial consumer protection. As follows:Chapter Ⅰ: Start from the plight of departure after the alienation of the basic valueof financial regulation before the U.S. financial crisis, the author gives the analysis ofthe political and legal dilemmas and the conclusion that lacking of financial consumerprotection guidance led to the failure of financial regulatory and ignoring the interestsof financial consumers induces financial crisis.Chapter Ⅱ: The author supplies the systematic analysis of the protection offinancial consumers and the necessity and importance as a fundamental value offinancial regulation from the point of the view of the legal perspective, Cross-disciplinary perspective of sociology and economics and the development ofregulatory history.Chapter Ⅱ: Financial regulation legislation should adhere to the tilt protectionprinciples, the principle of system protection, moderate protection principles and theprinciple of information disclosure, financial regulation rules should implement theseprinciples and spirit.Chapter Ⅳ: Introduces the current regulatory model of the world’s majoreconomies and financial regulation legislation involved in the part of the financialconsumer protection and the mode of China’s financial regulation and the status quo of financial consumer protection legislation.ChapterⅤ: Analyzes the problems of China’s financial consumer protectionmechanism and propose to reconstruct our financial consumer protection specificmechanisms from the view of financial consumer protection–oriented.Chapter VI: Concluding section reviews the context of full-text and calls on theimportance of the financial consumer protection, the return of the basic value of thefinancial regulation and reconstruction of China’s financial control mechanisms.
