Internet development is in its third wave now. It is in the stage of between freecompetition and monopoly, which is different from the previous two one. There isoligopoly even in some areas. The inevitable result of free competition is theformation of monopolies however. We have known that in recent years, theoccurrence that the monopolistic behavior of the Internet has emerged. We also foundthat a few Chinese Internet companies have become a de facto monopoly. And inrecent years appeared on the Internet monopoly abusing its market dominant position,free of invasion of privacy and the interests of users, and innovators curb, ignoring thephenomenon of the Internet and public interests.In the world wide, many Internet companies such as Intel and Google aredefendants in lawsuits. Some Antitrust authorities including the European Union,United States and Japan have launched their anti-trust investigations according totheir domestic law. In China though the Antimonopoly Law of People’s Republic ofChina is expected to improve the system of China’s anti-trust legislation, it is still farfrom enough. How to strengthen the deterrent power of anti-monopoly, as we know,monopolies can reduce the abuse of market power abuse of the behavior of the orderto maintain fair competition in the industry, fair market and trade justice, protection ofthe rights of Internet users has become a serious problem.This paper can be divided into three chapters:Chapter Ⅰ will be a clear statement of the Internet monopoly abusing its marketdominant position from two parts, the industry and the legislation. In Chapter Ⅱ thereis an introduction of the harm and the formation of Internet industry monopoly inChapter Ⅰ. In Chapter Ⅲ, the influencing factors which should be regarded under thespecial structure of the Internet industry is deeply researched. Besides, the particularmanifestation of the abusing of dominant position in Internet industry is analyzed in Chapter Ⅳ. The last chapter is a summarization of the legislative proposals toimprove and perfect anti-monopoly law. Based on the analysis of the current stageand shortage of anti-monopoly protection of Internet industry, suggestions on theways to perfect the related regulations and to make competition culture universal inorder to improve the competitive environment will be proposed.
