Research On Agricultural Seed Security Legislation Issues

The production and usage of agricultural seed are both closely related to the protection of peasant’s rights and interests. The prosperity of agriculture and the living of peasant depend on the security of agriculture seed. Agricultural seed industry severs as the basic, strategic core "chip industry" of the country. The security of the agricultural seed is the foundation of the national food security and the key to the stable development of agriculture, the harmony and stability of rural areas as well as the protection of peasant’s rights and interests. Having been putting emphasis on agriculture seed, the Chinese government promulgated The Seed Law of the People’s Republic of China.In the No.1Document of the Central Committee of CPC in2012, the technological innovation of the seed industry is an important content.To boost the development, we should promote the scientific and technological innovation in industry and give priority to the selecting of good seed. Seed is a carrier of agricultural science and technology. The industrialization of seed is the basis and guide of the modernization of agriculture. The consummation the legal system of the seed security is a protection of the construction of modern agriculture.With the further development of China seed industry, the foreign capital pours in to the open seed market, and the world-renowned multinational seed Group has entered China and occupied a place in the field of their respective crop, and all these brought more opportunities and greater challenges to China’s agricultural development and the protection of peasant’s rights and interests. The current international economic and food situation is complicated and grim, and shortage of domestic agricultural resources is increasing uncertainties. So if the main crop seeds are restricted to the enterprises of other countries and the degree of danger is self-evident. Compared to foreign multinational corporations, China’s modern agricultural seed security research started later, and the macroeconomic control policy and market regulation measures has to be developed, also in the agricultural seed research, management, access, services and supervision safety system need to be improved and established.This study based on the legal system of rural economic in Hua-zhong Agricultural University, with the main line of protection and development of farmers’ rights and interests, through the empirical survey study and literature consult, and give deep research in the main body incentives, industrial policy, access system, information security and administrative law enforcement sectors of China agricultural seed industrial chain, and conclude many security issues such as seed quality, technology, market, number, resource, industry, development and system security etc. strengthening research, regulating access, improving service etc.This study started from the actual situation of our agricultural seed industry development and explored relevant legal issues about the safety of China’s agricultural seeds. The main body of this research is including seven parts. The first part is introduction of the background, research purpose, research meaning of China’s agricultural seed security; The second part is a summary of the safety characteristics, study scope and the basic theory of law and economics of China’s agricultural seeds; The third part is the analysis of experience of the developed and developing countries agricultural seed security; The fourth part is the description of the safety status of China’s agricultural seeds and empirical research, discussing the historical stage and the development of the foreign legal system; The fifth part put forward the security problems about China’s agricultural seed research, management, access, services and supervision which attributed to factors such as the interests of the root; The sixth part proposes for the security problems of the agricultural seed, and makes recommendations to run security design from a system perspective; Part seven is a summary of the safety of China’s agricultural seeds, and propose some active and rational outlook such as raising farmers’ social status, international mergers and acquisitions, as well as encouraging capital to enter, science units to involve.
