The Research Of Copyright Statutory Licensing In Network Environment

The appearance and the rapid development of the network bring us a lot of convenience, it also brings us a lot of problems. A lot of without authorized work uploads onto the network space, many internet users get and use it freely. But facing the situation that mass network is used indiscriminately, the copyright owner appears helpless. There have been some explicit provisions about the statutory licensing system in domestic copyright law. However the deficiencies still exist in legislation and judicial practice of the statutory licensing system, so that the system has not met the needs of social development.Based on this problem, this paper makes the statutory licensing system as the research object, introduces the legal license system concept, the related concept differences and the different point of uses of network.Then it introduces the legal license regulations in foreign copyright law system, and analyzes the domestic legal license system and the development of the situation. At last this paper expounds the problems of our legal license system in the network environment, and puts forward the proposal of improving relevant laws and regulations.
