Discussion On Reasons And Preventions Of Torture To Extract Confessions

Extraction of confessions through torture is not a fresh topic. The Reform of Opening-up policy was implemented for thirty years, but the extraction of confessions through torture was still existed. Though a series of policies tried eradicate it, but failed. In recent years, a lot of cases about the extraction of confessions through torture shocked us, we must pay attention to this phenomenon and to protect human rights demanded to brook no delay. Now, how to eradicate the extraction of confessions through torture has become the focusing problem, the causes are complex, we should not only clearly understand the serious consequences but also understand the system deficiencies, then strive to solve these problems multi-directionally. My paper mainly analyzes the causes, the bad influences and the countermeasures of the extraction of confessions through torture, pointed out it’s not enough to curb extraction of confessions through torture in the total system level, it should be equipped with some relevant detailed operational rules. At the same time, we should change our idea, to reform judicial system, it always requires the common efforts of the society, look forward to the early arrival of real justice.
