Value Vicissitude Research On Legal Reform In Late Qing Dynasty

"Law is the tool of the king，reform is the truth of the word，，，in the late Qing dynastyof China", reform" is the only way to choose, and the biggest reform practice is the of lawsystem reform. As law always acts in the text and exists in the system, the value under thecover is the point. Why did the legal system in the late Qing dynasty change? What is it’ssoul and track? Although we are far away from these, these still can give us revelations.This article takes the legal reform and value vicissitude as the two ends of the researchwith "look" as the connection link, looking forward to get something new about the lawvalue vicissitude in late Qing dynasty，basing on formers’ achievements.Legal system reform in late Qing dynasty has a gradually process, which concernedboth idea and institution. There is three government’s practice about this: WesternizationMovement, Reform Movement of1898, Amendments to the Law in Late Qing Dynasty.The first movement makes us think to reform the institution, the second movement is thefirst practice on law system, and the third is the biggest law system reform. It speeded upChina’s law system reform. In its content，it launched ancient China a magnificent andvictorious law value vicissitude movement. This paper will talk about these movementsespecially the third one, looking forward to find the soul and the track of the law valuechanges in late Qing dynasty. The first part discusses the origin of value vicissitude. Thesecond part discussed several relative basic questions, such as question about thelegislation value, the conflict between tradition and modern, debates of legal mode,individual and family-national and son.I hope I can get a clearer and more systematic understanding about this legal reformand law value vicissitude.
