Research On The Conflict And Harmony Between The Power Of The Higher Education Management And The Right Of Students

With the accelerating process of China’s legal system and the deepening of reform of university management, the disputes between the universities and the students are rising substantially, and the parties concerned are more likely to turn to judicial channels, the increasing lawsuit raised by them are perfect illustrations. Colleges continue to be the defendant, on the one hand, that students continue to strengthen awareness of rights, higher education management has been an unprecedented challenge, it also exposed the universities in the exercise of the right to education management process. There are many issues that need to constantly improve their own management.Based on the full investigation, the author analyzes the management of higher education and student rights conflict and coordination and proposes my own sound advice.Article is divided into four parts:The first part briefly describes the status of university management and the concept, content, security status of the rights of students. The protection of the rights of students in recent years is improving, but still not optimistic. We have to attach more attention on the problems that happened during the management in colleges.The second part focuses on specific forms of conflict between the management of higher education and the rights of students. It mainly related to the making of school rules, daily management, the certificate-issuing., in which the conflicts between the rights of students and the management of higher education are sharp, including the conflicts of rights of education, of property and of person about students.The third part discusses causes of the conflicts between the management of university education and student rights. The mainly reasons are obscure of the legal relationship in higher education, the lack of sense of human rights law, the flaws of legislative system, unregulated managerial behavior and bad almsgiving.The fourth part of the article I have put forward the solutions on the conflict between the college management and student rights. We have to unceasingly improve the model of the management in higher education, perfect the education law as well as increase the almsgiving so that we can fundamentally ease the conflicts between the power of higher education management and the rights of students.
