But the law lags behind, causes more and more related disputes. The demanding of protection of virtual property through legislation and judicial protection is growing, which also becomes the concern of legal circles, and sparks intense argument.Virtual property refers to the network-based games, which exists in the network game, pre-controlled by the game operator. The players acquire the equipments through varieties of online games which stored in the server, and the game controllers can create or join games data and parameters under certain conditions. And this paper researches and analysis of the reasons for the legal protection because of its general property nature and social influence; also because it is a special property, which decides its special protection form; and now Virtual property is currently under serious infringement and needs an urgent legal protection. The status of virtual property is the lack of legislation, legal property dispute, the case jurisdiction is unclear to promote the development of network industries, it is necessary to take use of experiences from abroad and China’s Hong Kong, Taiwan, especially the jurisdiction of the improvement of legislation to increase the establishment of a formal dispute resolution mechanisms and trading platform as well as formal evidence of evidence-gathering procedures.
