As a new mechanism handing the criminal disputes, victim-offenderreconciliation system has overcome the inherent defects of the imprisonment andtraditional penalty and taken into account the double protection of the offender andvictim’s legitimate rights and interests.At the same time,it maximizes the recovery ofrelations acted by the criminal act.So it is a concern both in the legal theory and thepractice realm.Based on our judicial practice, it conducts a comprehensive demonstration ofChina’s application of the victim-offender reconciliation system in using historicalanalysis, comparative analysis and other methods. The first chapter introuduces thebackground of the victim-offender reconciliation system,the theoretical originsand,concept and the distinction between the related concepts,so as to have acomprehensive and accurate understanding of the victim-offender reconciliationsystem.The second chapter provides a reference to our country in establishing thevictim-offender reconciliation system by introducing the development andcharacteristics of the victim-offender reconciliation system in the UnitedKingdom,France,Germany and other countries.The third chapter demonstrates thenecessity in application of the victim-offender reconciliation system by introuducingthe drawbacks in our traditional criminal justice,so as to provide a realistic basis forthe victim-offender reconciliation system.The fourth chapter discusses the dilemmaand outlet in the theory and practice to clear the way for the victim-offenderreconciliation system.The fifth chapter designs the victim-offender reconciliationsystem from applicable principles, scope and applicable conditions.
