Since1992, the market economy system was established in China, a new type of economic legislation-promoted economic legislation is gradually on the rise and more and more arouses academic circle and legislative circles. This is different from the traditional management model of economic law legislation in order to "promote" name, in order to promote or promoting a social order form as the main purpose, to "guide, promote, encourage, promote, support, reward" as the main means, to advocate the norm as the main carrier, so the academia will collectively referred to as" promotion economic legislation". As a relatively new topic, at present our country carries on the comprehensive and thorough research is very limited, but on a country’s economic development and social stability is strong drive potential can not be ignored and underestimated, therefore the author selected as the research object, through the hermeneutics of law, law and economics, sociology of law and comparative study of a variety of methods such as the attempt to be as comprehensive as possible to analyze this phenomenon promoted economic legislation.This paper is divided into three parts to promote economic legislation is analyzed and elaborated:The first part, the author summarizes our country to promote legislation current situation and pointed out its existing obstacles, in short, at present our country promote legislation is still in the" adolescence", although it has the vigorous vitality it is a long way to go.The second part, the author from the five aspects of promoting the economy legislation was analyzed, including the economic, political, social and legal background; function positioning; promote" conservative" means "induced"; five types of norms; legal responsibility of government responsibility is integrated (including not only the legal liability, is more of a moral responsibility, social responsibility and political accountability) and other legal liability is relatively weak.The third part, the author will promote the economic law and the traditional management model of economic law undertook contrast, found in the management of economic law in the law enforcement and information access limitations and highlights the promoted economic law of comparative advantage. Specifically, management of economic law in the law enforcement is easy to appear the lack of law enforcement resources," selective law enforcement" as well as the confrontation and cooperation dilemma three issues; in information acquisition was the existence of information asymmetry and uncertainty two big problems. Finally, the author elaborated from four aspects how to improve our country promoted economic legislation, including the importance of promoting economy legislative effect; the vigilance promoting economic legislation flood; reasonable configuration promoted economic legislation and enhance the effectiveness of promoting economy legislation.To sum up, this article from the angles of China to promote economic legislation was analyzed, and learn from foreign advanced legislation experience in the theory and practice, although it is not perfect and development, also the expectations for China to promote economy legislation to provide a reference point, to the best of my legal person a silk thin force.
