Pre-study On The Legislation Of Promote The Development Of Xiamen Marine Economy In New Era

Since the beginning of the new era,both the Communist Party of China and the government have attached great importance to the development of the marine economy,and speeding up the construction of a powerful marine country has played an important role in achieving Chinese Dream,safeguarding national sovereignty and promoting the construction of ecological civilization.It is of great significance to realize the goal of building a moderately prosperous society in all respects.As an important part of China economic development,a sound legal system provided a strong support for marine economic development.Xiamen,as a special economic zone with local legislative power,a demonstration area of national marine economic innovation and development,and a core city of the 21st century Maritime Silk Road,can carry out institutional innovation.The problems in the process of marine economic development could be adjusted by legal means.In this context,this paper attempts to synthesize the current situation of China marine economic development and the practices of promoting marine economic development.At the same time,drawing lessons from the successful experience of foreign countries in the legal promotion system of marine economic development and the implementation of local laws and regulations issued by China coastal provinces and cities in order to promote the development of marine economy,combined with the practice of marine economic development in Xiamen in recent years,based on the analysis of the shortcomings of the current legal system of Xiamen marine economic development and the concrete data of Xiamen marine economic development,this paper analyzes the feasibility of Xiamenlegislation to promote the development of the marine economy.The corresponding legislative suggestions and prospects are given to promote the healthy and orderly development of Xiamen marine economy through institutional innovation.This paper is divided into six parts,the specific contents are described as follows:The first part focuses on the background and basis of the topic,the main ideas and methods of the study,as well as the innovation of this study.The second part mainly discusses the theoretical basis of marine economic development.Through the legal definition of marine economy,the concept of marine economy is summarized,and the specific scope of marine economy is further given,and the legal characteristics of marine economic development are put forward by synthesizing the current academic research on the development of marine economy and putting forward the legal characteristics of the development of marine economy.Under the guidance of efficiency theory,fairness theory and public choice theory,the development of marine economyin Xiamen is studied systematically.The third part reviews the development of marine economy in China since the beginning of the new era,and combining with the data of marine economic development during the 13th five-year Plan period,analyzes in-depth the relevant practices and current laws,regulations and policy plans for the development of marine economy in China.It lays the groundwork for the legal research on the development of Xiamen marine economy.The fourth part,taking the practice of developing marine economy in extraterritorial countries and domestic coastal provinces as an example,makes a comprehensive analysis from three aspects:the legal promotion mechanism in various regions,the relevant practices in the development of marine economy,and the existing laws,regulations and policy plans.On the basis of their successful experiences,some references for Xiamen’s marine economy development are summarized.The fifth part mainly analyzes the practice and improvement of Xiamenmarine economic development,summarizes the general situation of Xiamenmarine economic development in recent years and the specific situation of each marine industry through the data and carries on the SWOT analysis to Xiamenmarine economic development.The development strategy that can be chosen is given.The sixth part elaborates the practice and the existing legal problems of Xiamen marine economic development in detail,through the actual situation of Xiamen,analyzes the feasibility of Xiamen legislation to promote the development of the marine economy,and puts forward six legislative suggestions and legislative prospects,in order to promote the sustainable development of Xiamen marine economic development.
