Study On Several Issues Of Public Security Video Legislation In Shenzhen Special Economic Zone

Since 2006,Shenzhen has launched three large-scale public security video image information systems.The total number of cameras is over 1.3 million.The scale,density and application of the system are in the forefront of the whole country.But at the same time,there are some problems of social concern and strong reaction: First,the non-standard construction management directly affects the efficiency of public security prevention.Second,the problem of privacy protection in public security video images is outstanding.Third,The open and service of public video and image data is lack of regulation.It is urgent to standardize the public security video image information management by legal means.There are no national laws and regulations in the upper-level law.The Guangdong province "Guangdong province public safety video and image information system management method" has been enacted earlier.There are some problems such as unclear installation scope and responsibility subject,unclear power and responsibility of construction and supervision,imperfect management and application mechanisms,and insufficient penalties.It is relatively weak for video information security,video surveillance staff management,and so on,so it is difficult to adapt to the needs of current situation development and management.To this end,Shenzhen plans to regulate the public security video through the Legislation in Special Economic Zones.This article is the author's Thoughts on related issues in the process of participation in legislation.The first is the study on the definition of public safety video,refining the definition of public area,redefining the installation range and responsible subject of public security video system,sorting out and expanding the relevant regulations and provisions,as a local legislation,more close to the people's life,and enhancing the comprehensibility and enforceability of laws and regulations.The second is to analyze the main bodies involved in the construction,management,maintenance and use of public safety videos,clearly define the responsibilities of different subjects.It can effectively standardize the planning,construction,application and management of the public safety video and image information system,and improve the use efficiency and information security of the public safety video image information system in an all-round way.The third is to compare the administrative licensing requirements of the "Public Security Administration Punishment Law","Fire Law"," Special Equipment Safety Law of People's Republic of China " for the special industries and special equipment.Put forward the proposals for the reform of the production of public safety video equipment,system construction,maintenance,etc.The administrative licensing reform proposals of the operation reflect the current spirit and requirements of the government's transformation of “simple administration,decentralization,integration,and optimization of services”.The fourth is to enumerate and analyze the different scenarios,start from the administrators,users,and beneficiaries,distinguish social management,fight crime and serve the masses,balance the relationship between public management needs and privacy protection,put forward the rationalization advice for the use and supervision of the public safety video information.
