Legal Pondering Of China’s Rural Tourism Environment

In recent years, with the new demands for urban residents to travel, rural tourism becomes a new way of travel for the urban residents to gain knowledge from entertainment and return to nature, and it thus ushers a rapid development. However, there have also emerged many problems along with rural tourism development. For instance, the long-term unreasonable exploitation and abuse of resources has affected the rural regeneration capacity of the ecosystem itself. Thereby, maintenance to the damaged ecological environment to restore its ecological functions and values can achieve the sustainable development of rural tourism. In the development of rural tourism, it will be just that the beneficiaries compensate for their losers.In recent years, the environmental effects arising out of rural tourism have begun to attract people’s attention, in which many voices of criticism rebound. Compared with the early concept that regards tourism as smokeless industry, a progress of cognition has been seen. Actually, rural tourism can acquire long-term development without causing environmental degradation in rural areas. Currently, rural tourism has become a hot issue studied in fields of ecology, environmental economics, environmental management and sustainable development of ecology. In this thesis, the development status of village tourism at both home and abroad was combined to study the village tourism and compare the general situation of tourism legislation at both home and abroad, and also discuss the legislative defects of tourism in China at the same time. For these living issues, the author referred to the advanced experience of village tourism development and tourism legislation in abroad, emphatically started from environmental economics and science of environment and natural resources protection law to put forward suggestions to improve China’s tourism legislation and legal countermeasures toward rural tourism development.In this thesis, the author mainly adopted the knowledge of environmental economics and science of environment and natural resources protection law to solve the environmental issues of China’s rural tourism, which was innovative. To solve the environmental issues in rural tourism development, the legislation should be improved with connection of two aspects. First of all, China should formulated a Basic Law of Tourism as soon as possible to promote the healthy development of rural tourism by the mandatory legal means, and then add the environmental management regulations of tourism into the law to enhance the enforcement of rural tourism regulations in all regions through the legislation of authority. Second, protection strengthening of rural tourism environment through Environment and Resources Protection Law. Thus, the environmental issue of rural tourism can be solved finally by the improvement of legislation, and the sustainable development of rural tourism can be insured as well.
