Separation Of Prison And Enterprises:Prison System Reform In Our Country

Prison is the national criminal penalty executive agency, it is an important part of the state apparatus, the basic task for prison is to punish and reform criminals. To public administration, the management system of administrative organs is the system concentrated on the agency establishment and management formulated by the state. Prison management system includes the national leadership structure and the internal management organization structure.For a long time, our jail internal management organization structure is "prison and enterprises combine together". Prison and the prison enterprise is essentially the same unit. It is called XX prison internally and XX factory or XX company externally. In the new situation, this old system is exposing malpractices seriously and it is restricting the development of our prison’s improvement. Consequently, the prison system reform is imperative.In2003, the justice department put forward to gradually realize the goal of "full support, separate the jail and the enterprises, separate the income and expenses, regul-ate the operation". In the same year, Hei Longjiang, Shanghai, Jiangxi, Hubei,Chong-qing, Shanxi provinces were selected for reform experimentation. In2008, the prison system reform to separate the jail and the enterprises was conducted through-out the nation, the goal is to establish a fair, honest, civilization and efficient new prison pen-alty execution system with Chinese characteristics in the year of2011. At present, we have made some progress for the prison system reform in clearing the powers and re-sponsibilities of the prison and enterprises new prison system has initia-lly formed. This is the most important part in prison system reform. So, how to solve the key pro-blem will lead to the success or failure of our prison system reform and it is really necessary to study.In this paper, the present situation, the causes to reform in our national prison system was stated, we learn from the foreign enterprise management system and our present prison system, some difficult problems related to separation of the prison and the enterprises were discussed. The paper demonstrates that the fully funds support is the premise to the separation of the prison and enterprises, it’s necessary to modify and formulate the relevant laws and regulations. In this paper, many innovations were stated to establish a scientific personnel management mechanism, a incentiverestrict-ed mechanism, a criminals labor resource allocation mechanism, a criminal reward mechanism and a corporate governance improving mechanism.
